السؤال:
أم وابنها يريدان أداء العمرة عن الأب في نفس الوقت ، ونفس العمرة ، مع العلم أن الأب ميت ، فهل يجوز هذا ؟


الجواب : الحمد لله نعم ، يجوز للشخصين أن يؤديا العمرة عن شخص واحد ولو في نفس الوقت ، بحيث يقوم كل واحد منهما بعمرة مستقلة عن ذلك الشخص . قال ابن قدامه رحمه الله " وإن استناب رجلين في حجة الإسلام , ومنذور أو تطوع , فأيهما سبق بالإحرام , وقعت حجته عن حجة الإسلام , وتقع الأخرى تطوعًا , أو عن النذر ; لأنه لا يقع الإحرام عن غير حجة الإسلام , ممن هي عليه , فكذلك من نائبه " انتهى من " المغني " 3/104 . وقال الشيخ ابن عثيمين رحمه الله : " مسألة : هل يجوز لرجل أن ينيب من يحج عنه أكثر من واحد في عام واحد ؟ الجواب : يجوز ذلك ، لكن إذا أناب اثنين ، فأكثر في فريضة فأيهما يقع حجه عن الفريضة ؟ الجواب : من أحرم أولاً ، وتكون الثانية نفلاً " انتهى من " الشرح الممتع " 7/33 .
فعلى هذا ، يجوز لكما أن تؤديا العمرة عن ميتكم في وقت واحد ، على أن يقوم كل واحد منكما بأداء عمرة مستقلة عن الآخر ينوي بها العمرة عن الميت . والله أعلم

A mother and her son want to do ‘umrah on behalf of the father at the same time, and do the same ‘umrah. Please note that the father is deceased. Is that permissible?


Praise be to Allah Yes, it is permissible for two people to do ‘umrah on behalf of one person, even if that is at the same time, because each of them is doing ‘umrah independently of the other, on behalf of that person.
Ibn Qudaamah (may Allah have mercy on him) said:
If he appoints two men to do Hajj on his behalf in the case of the obligatory Hajj, Hajj in fulfilment of a vow, or a voluntary Hajj, then whichever of the two enters ihram first, his Hajj will count for the obligatory Hajj, and the other will count as a voluntary Hajj, or in fulfilment of a vow, because he cannot do any Hajj before the obligatory Hajj, and the same applies to one who is acting on his behalf.
End quote from al-Mughni (3/104).
Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said:
Question: is it permissible for a man to appoint more than one person to do Hajj on his behalf in the same year?
He replied: That is permissible, but if he appoints two or more people to do an obligatory Hajj on his behalf, then which of them is doing the obligatory Hajj on his behalf? The answer is: the one who enters ihram first, and the second Hajj counts as naafil (supererogatory).

Based on that, it is permissible for you both to do ‘umrah on behalf of your deceased loved one at the same time, so long as each of you does his or her ‘umrah independently of the other, intending to do ‘umrah on behalf of the deceased.

Oui, deux personnes peuvent accomplir le pèlerinage mineur en même temps pour le compte du même bénéficiaire et de manière à ce que chaque personne fasse le pèlerinage avec l'intention de la dédier audit bénéficiaire.
Ibn Qoudama (Puisse Allah lui accorder Sa miséricorde) a dit: «Si quelqu'un donne mandat à deux personnes pour accomplir à sa place un pèlerinage obligatoire, ou répondant à un vœu ou surérogatoire, celle qui commence le pèlerinage la première aura accompli pour le mandataire le pèlerinage requis. Le pèlerinage accompli par la seconde aura un caractère surérogatoire ou répondra au vœu. C'est parce que le pèlerinage commencé pour le compte de quelqu'un qui n'a jamais fait le pèlerinage ne peut avoir autre chose qu'un caractère obligatoire. Il en est de même pour un mandant qui n'a pas encore fait le pèlerinage obligatoire. (Extrait d'al-Moughni, 3/104).
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) a dit:
«Question: est-il permis à un homme de se faire remplacer au pèlerinage par plusieurs personnes la même année? Réponse: oui, c'est permis. Mais si on donne mandat à deux personnes ou plus pour faire le pèlerinage obligatoire, la quelle des deux personnes aura fait le pèlerinage demandée? Réponse: celle qui entrera la première en état de sacralisation. Le pèlerinage fait par la seconde personne aura un caractère surérogatoire.» Extrait de charh al-moumt'i (7/33).
Cela étant, vous pouvez accomplir le pèlerinage en question simultanément pour le compte de votre mort. Chacun de vous fera un pèlerinage mineur à part avec l'intention d'agir pour le compte du défunt.
